<p>当蓝车进入到主干道之后，黄车采取了一种低级的方式。而这种方式，在刑法的角度来看，<strong style="box-sizing: inherit; font-style: normal;">会有可能涉嫌到故意毁坏财物的行为。</strong></p>
<p>对于这种故意毁坏财物的行为，是不是能构成犯罪，还要看它对于蓝车所造成的损失有没有达到数额较大的情形。如果是数额较大，是有可能涉嫌故意毁坏财物罪。</p>
<p>在司法实践当中，对于这种开斗气车的行为也有一些案例，是将类似黄车的这种行为作为寻衅滋事罪加以处罚。</p>
<p>当黄车车主发泄完他的怒火后，就开始往前继续行驶，而蓝车又继续追赶，将黄车给挤到过道旁边，从而使黄车车身翻越护栏。根据以往的判例，上海其实在2018年的时候，也发生过类似的开斗气车的行为。对于那起案件当中，最终法院是以行为人构成了<strong style="box-sizing: inherit; font-style: normal;">以危险方法危害公共安全罪的罪名来定性的</strong>。</p>
<p>马教授补充道：黄车一开始别车的时候，车流量比较大，在视频当中，黄车的刹车行为还导致车辆左后方的白车紧急刹车。公安机关可能会对整个案发过程做一个综合考虑，最终也可能将黄车驾驶员的行为认定是危险方法危害公共安全罪。</p>

<p><strong style="box-sizing: inherit; font-style: normal;">是否构成危险驾驶罪？</strong></p>
<p>根据《刑法》第133条之一，关于危险驾驶罪的一个规定，它要求双方必须是追逐竞驶这样一个行为。而在本案当中，显然双方车辆的驾驶速度其实并不是特别快，主要是为了发泄怒火，而缺少追逐竞驶的情节，因而不构成危险驾驶罪。</p>

<p><strong style="box-sizing: inherit; font-style: normal;">是否构成交通肇事罪？</strong></p>
<p>根据《刑法》第133条的规定，交通肇事罪是以行为人的过失导致了一些严重后果发生的，才可能构成交通肇事罪。但是在本案当中，两个涉案的驾驶员都是故意的行为，所以不是一种过失导致的，所以不可能构成交通肇事罪。</p>
